1. Use of the Service

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Ordering and Payment

2.1 Order Acceptance

All orders placed through our Service are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or issues with your account or payment method.

2.2 Pricing and Availability

All prices are shown in Canadian Dollars (CAD) and include applicable taxes. We make every effort to ensure that our product information, including prices, is accurate and up to date. However, errors may occur. If we discover an error in the price of products you have ordered, we will contact you as soon as possible to give you the option of confirming your order at the correct price or canceling it.

Product availability is not guaranteed. If a product is unavailable after your order has been placed, we will notify you and offer a reasonable substitute or cancel that portion of your order.

2.3 Payment

We accept various payment methods as indicated on our Service. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order (including any applicable taxes and other charges).

If the payment method you provide cannot be verified, is invalid, or is otherwise not acceptable, your order may be suspended or canceled. You must resolve any payment problems before your order can be processed.

3. Delivery

3.1 Delivery Areas

Delivery is available within our designated delivery areas. You can check if your location is within our delivery area by entering your postal code on our website or app.

3.2 Delivery Times

We strive to deliver your order within the estimated delivery time provided at checkout. However, delivery times are estimates and not guaranteed. Various factors, including weather conditions, traffic, and high order volumes, may affect delivery times.

3.3 Delivery Address

You are responsible for providing an accurate and complete delivery address. We will not be liable for any delays or inability to deliver due to incomplete or incorrect delivery information.

3.4 Delivery Fees

Delivery fees may apply and will be clearly indicated during the checkout process. Minimum order amounts may be required for delivery.

4. Intellectual Property

4.1 Service Content

The Service and its original content, features, and functionality are and will remain the exclusive property of PIZZAPIZZA and its licensors. The Service is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PIZZAPIZZA.

4.2 User Content

By posting, uploading, or otherwise making available any content on our Service (including reviews, comments, and feedback), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the content you post, that the content is accurate, and that use of the content does not violate these Terms and will not cause injury to any person or entity.

5. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable federal, provincial, local, or international law or regulation
• To impersonate or attempt to impersonate PIZZAPIZZA, a PIZZAPIZZA employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm PIZZAPIZZA or users of the Service or expose them to liability
• To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service
• To attack the Service via a denial-of-service attack or a distributed denial-of-service attack

6. Disclaimers

6.1 Service "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. PIZZAPIZZA makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.

6.2 Accuracy of Information

While we strive to provide accurate product information, including pricing, ingredients, nutritional information, and allergen content, we do not warrant that product descriptions or other content on the Service are accurate, complete, reliable, current, or error-free. If a product offered by the Service is not as described, your sole remedy is to return it in unused condition.

6.3 Allergies and Dietary Restrictions

We take food allergies and dietary restrictions seriously and make reasonable efforts to provide accurate information. However, we cannot guarantee that any food item will be completely free from specific allergens due to potential cross-contact during preparation. If you have severe food allergies, please contact us directly before placing an order.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PIZZAPIZZA, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Service;
2. Any conduct or content of any third party on the Service;
3. Any content obtained from the Service; and
4. Unauthorized access, use, or alteration of your transmissions or content;

whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In any case, our total liability to you for all claims related to the Service shall be limited to the amount you paid to us for your most recent order, or $100 CAD, whichever is greater.

8. Indemnification

You agree to defend, indemnify, and hold harmless PIZZAPIZZA, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the courts located in the Province of Quebec, and you consent to the personal jurisdiction of such courts.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. The most current version will be posted on our Service with the effective date. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
